PART 

General Provisions

Article 1  These specific rules are enacted in accordance with the Frontier Health and Quarantine Law of the People’s Republic of China (hereinafter referred to as the Frontier Health and Quarantine Law ).

 

Article 2   Definitions

For the purpose of the Frontier Health and Quarantine Law and these specific rules –

“inspection” means medical examination and sanitary inspection made by the frontier health and quarantine organization (hereinafter referred to as the health and quarantine organization );

“infected person” means a person who is suffering from a quarantine disease, or who is preliminarily diagnosed by the health and quarantine organization as having been infected with or having been incubating such a disease;

“suspect” means a person exposed to infection by a quarantinable disease and capable of spreading that disease;

“isolation” means segregating an infected person at a designated place so as to restrict his activities and give him medical treatment until there is no danger of spreading a communicable disease;

“under observation” means putting a suspect at a designated place for examination and inspection;

“medical examination on the spot” means a person going, at the time designated by the health and quarantine organization, to a nearby health and quarantine organization or other medical and health institution for examination, or is examined at his dwelling place by the health and quarantine organization or other medical and health institution;

“transport equipment” means freight containers;

“health measures” means such medical measures as isolation, under observation and medical examination on the spot, and such sanitary measures as disinfection, deratting and disinsecting;

“surveillance of communicable disease” means the investigation of specific surroundings, humans groups and other related elements in epidemiology, serology, aetiology and clinical symptoms, and prediction of occurrence, expansion and epidemic of a communicable disease;

“Sanitary supervision” means sanitary inspection, identification, evaluation and sample examination in the implementation of Health Laws and Regulations and Health Standards;

“means of transport” means ships, aircrafts, trains and other vehicles;

“frontier port” means international ports, airports, railway stations, land frontiers and frontier posts on boundary rivers.

 

Article 3   The scope of the work of the health and quarantine organization at a frontier port covers all hotels, restaurants and clubs thereat with service to foreigners, all units providing food and beverage and services to inbound and outbound means of transport, and all places where quarantine inspection, surveillance and sanitary supervision are applied to persons, means of transport, containers and goods upon entering or leaving the territory.

Article 4   All persons, means of transport and containers as well as luggage, goods and postal parcels that may possibly transmit a quarantinable disease shall be subject to quarantine inspection upon entering or leaving the territory in accordance with these specific rules. Permission of entry or exit can only be granted the approval of the health and quarantine organization.

 

Article 5   The health and quarantine organization, upon detection of an infected person, shall immediately put him in isolation, take precautions to prevent any other person from being infected and apply measures provided for in Part VIII of these specific rules. The health and quarantine organization, in finding any suspect, shall treat him according to the provisions contained in Part VIII of these specific rules; in case of a suspect for whom no measures provided in Part VIII of these specific rules are appropriate, it may apply medical examination on the spot or place him under observation for a period not exceeding the longest incubation period of the very communicable disease, reckoned from the date of his leaving the infected environment; or it may apply other health measures.

 

Article 6   Thehealth and quarantine organization shall prevent any infected person or suspect from leaving the territory, but shall allow the departure of any person from abroad, who has subjected himself to medical examination on the spot upon his arrival and has requested to leave the territory by means of transport, the quarantine doctor shall record the fact on the pratique for departure and notify the person in charge of the means of transport to carry out necessary preventive measures.

 

Article 7   The corpse of a person who died of any unidentified cause other than an accident at a frontier port or on an inbound or outbound means of transport staying thereat shall not be removed and transported until it has been examined by the health and quarantine organization and a permit for removal  and transportation of corpse issued.

 

Article 8  In the event of any means of transport from an infected area within the country or on which a quarantinable disease or a suspected quarantinable disease or any death due to an unidentified cause other an accident is discovered during the voyage in the country, the person in charge of the means of transport shall notify the health and quarantine organization at the frontier port of arrival for a provisional quarantine inspection.

 

Article 9 In the event of an epidemic of a quarantinable disease at home or abroad, the National Health Administration under the State Council shall immediately report to the State Council for decision to take the following quarantine measures partly or wholly:

1)        to blockade the area concerned on the land frontier or on the boundary river;

2)        to subject certain articles to disinfection and disinsecting before it is transported into or out of the country;

3)        to prohibit certain articles from being transported into or out of the country;

4)        to designate the first port of entry and the first airport for landing; any ship or aircraft coming from an infected area abroad, unless in wreckage or for other particular reasons shall not be allowed to enter any other port or to land at any other airport without being quarantine at the first port of entry or the first airport for landing.

Article 10   On arrival at a port of incoming or outgoing containers, goods and waste and used articles, the carrier or his agent or the owner shall apply to the health and quarantine organization for sanitary inspection; the disinfection, deratting, disinfecting or other necessary sanitary measures shall be applied to any container, goods and waste and used article coming from an infected area, or contaminated by a communicable disease and likely to transmit a quarantinable disease, or found to be with rodents and insect vectors harmful to human health.

The health and quarantine organization may, at the request of the owner of the container, goods and waste and used article, allow quarantine inspection and sanitary treatment to be conducted at another place in accordance with the relevant rules.

The customs shall release them only with a certificate of sanitary treatment issued by the health and quarantine organization.

 

Article 11 Thecarrierthe consigner or postman of such special products as microbes, human tissues, biological products, blood and blood products taken into or out of the territory shall report to the health and quarantine organization for quarantine inspection. No such products are allowed to be carried into or out of the territory without the permission of the health and quarantine organization.

The customs shall release them to go through only with a certificate of special products issued by the health and quarantine organization.

 

Article 12  The sanitary inspection shall applied to any luggage and goods likely to transmit a communicable disease, carried or consigned by passengers or crew members entering or leaving the territory. The health and quarantine organization shall take sanitary measures on any food, beverage and aquatic product from an infected area or contaminated by a communicable disease, or cremate them and then issue a certificate of sanitary treatment.

The customs shall release them only with a certificate of sanitary treatment issued by the health and quarantine organization.

 

Article 13  The postal department shall cooperate with the health and quarantine organization when it carries out quarantine inspection and necessary treatment over postal parcels in need of quarantine. No postal parcels shall be delivered without the permission of the health and quarantine organization.

Article 14 The category, type and issuance of quarantine forms or certificates shall be specified by the National Health Administration under the State Council.

PART 

Notifications and Epidemiological Information

Article 15 When a quarantinable disease or a suspected quarantinable disease has been discovered, or a person died of unidentified cause other than an accident at a frontier port or on the means of transport staying thereat, the person in charge of the organization concerned at the frontier port or of such means of transport shall notify the health and quarantine organization immediately.

Article 16  The health and quarantine organization, on discovering a quarantinable disease, a communicable disease under surveillance or a suspected quarantinable disease, shall immediately notify the local health authority and the local health and epidemic prevention institution; in case of a quarantinable disease, it shall also immediately notify the National Health Administration under the State Council by the most expeditious means.

The local health and epidemic prevention institution, in finding a quarantinable disease or a communicable disease under surveillance, shall notify the health and quarantine organization.

Article 17  When an epidemic of a quarantinable disease occurs at a certain local area inside or outside the country, the National Health Administration under the State Council may declare such area as an infected area.

 

PART 

The Health and Quarantine Organization

Article 18 The health and quarantine organization, as their service requires, may establish outpost agencies. The establishment, amalgamation or withdrawal of the health and quarantine organization shall be decided by the National Health Administration under the State Council.

 

Article 19  The functions of the health and quarantine organization are :

1)     to enforcing the Frontier Health and Quarantine Law of the People’s Republic of China and its specific rules, and other relevant National Health Laws and Regulations;

2)     to collect, collate and report information on the occurrence, prevalence  and termination of communicable diseases outside the country or at the frontier ports;

3)     to supervise the sanitary conditions at a frontier port; and to apply quarantine inspection, communicable disease surveillance, sanitary supervision and sanitary treatment to means of transport, persons, containers, corpses and human remains entering or leaving the territory and to luggage, goods and postal parcels likely to transmit a quarantinable disease;

4)     to apply quarantine inspection to the special products including microbes, biological products, human tissues, blood and blood products carried into or out of the country, and to animals likely to transmit a human communicable disease;

5)     to provide incoming and outgoing persons with vaccination, physical examination, medical services, health counseling for international travel and health education;

6)     to issue quarantine certificates;

7)     to engage in epidemiological studies and scientific experiment;

8)     to carry out other service assigned by the National Health Administration  under the State Council.

 

Article 20  The responsibilities of sanitary supervisors at a frontier port are:

1)     to carry out sanitary supervision and health education over a frontier port and any inbound and outbound means of transport staying thereat;

2)     to provide technical guidance on sanitary treatment such as disinfection, deratting and disinsecting;

3)     to investigate and propose control measures on events resulting in the transmission of a communicable disease, dissemination of rodents and insect vectors, food poisoning and food contamination.

Article 21  The officers of the health and quarantine organization and the sanitary supervisors at frontier ports while on mission shall wear quarantine uniforms and mark; the means of transport of the health and quarantine organizations while on duty shall fly quarantine flags.

The design and use of the quarantine uniform, mark and flag shall be specified by the National Health Administration under the State Council together with the departments concerned and approved by the State Council.

 

PART 

Seaport Quarantine

Article 22 The quarantine of entering ships shall be applied at he quarantine anchorage of a port or at the specific place approved by the health and quarantine organization. The quarantine anchorage shall be designated by the health and quarantine organization in consultation with the Harbour Superintendency Administration, and reported respectively to the National Communications Administration and the National Health Administration under the State Council for reference.

 

Article 23   The shipping agency shall, prior to the arrival of a ship which is subjected to entry quarantine, inform the health and quarantine organization as early as possible of the following:

1)     name and nationality of the ship and scheduled time and date of arrival at the quarantine anchorage;

2)     port of sailing and last port of call;

3)     number of crew members and passengers on board the ship;

4)     category of the cargo.

The Harbour Superintendency Administration shall inform the health and quarantine organization as early as possible of the exact time and date of arrival of the ship at the quarantine anchorage.

 

Article 24  If, during its voyage, a case of a quarantinable disease or a suspected quarantinable disease is discovered, or a person died of an unidentified cause other than an accident on board a ship which is subject to entry quarantine, the captain of the ship shall report immediately to the health and quarantine organization at the port of the quarantine of the following :

1)     name and nationality of the ship and scheduled time and date of arrival at the quarantine anchorage;

2)     port of sailing and last port of call;

3)     number of crew members and passengers on board the ship;

4)     category of the cargo;

5)     name of the disease or main symptoms, and number of cases and deaths;

6)     whether or not a ship’s surgeon on board.

 

Article 25  Any ship which is subject to entry quarantine must hang up the quarantine signal and wait for inspection according to the following provisions. It is not allowed to lower the quarantine signal until an entry pratique has been issued to it by the health and quarantine organization.

The quarantine signal of a ship is in the day time to fly a signal flag of international code.

1)     “Q” flag signifies that the ship is not infected, requesting the issuance of an entry pratique;

2)     “QQ” flag signifies that the ship is infected or suspected, requesting immediate quarantine;

The quarantine signal in the night time shall be bung up perpendicularly at a prominent place:

1)     three red lamps signifies that the ship is not infected, requesting the issuance of an entry pratique;

2)     four lamps (red, red, white and red)signifies that the ship is infected of suspected, requesting immediate quarantine.

 

Article 26  Except the pilot or those permitted by the health and quarantine organization, no person is allowed to embark on a ship with the quarantine signal, and no such articles as luggage, goods and postal parcels are allowed to be loaded or unloaded, nor another ship is allowed to approach it. Except in wreckage, no person on board the ship is allowed to disembark and no pilot is allowed to guide the ship out of the quarantine anchorage without the permission of the health and quarantine organization.

 

Article 27 Any ship requesting free pratique by radio shall apply to the health and quarantine organization for sanitary inspection in advance. The certification of sanitary inspection can only be granted to the ship upon the fulfillment of all criteria of sanitary inspection. The ship may request free pratique by radio in 12 months reckoned from the date of issue of the certificate.

 

Article 28 Any shipin possession of a valid certificate of the sanitary inspection shall within 24 hours before arrival report to the health and quarantine organization the following:

1) name and nationality of the ship and scheduled time and date of arrival at the quarantine anchorage;

2) port of sailing and last port of call;

3) number of crew members and passengers and their health conditions;

4) category of the cargo;

5) date of issue and registration number of the certificate of sanitary inspection; date and port of issue of the Dereatting Certificate or the Deratting Exemption Certificate as well as other health certificate.

The ship may enter the harbour after obtaining the reply of approval to the above-mentioned report from the health and quarantine organization.

 

Article 29 The entry quarantine inspection of a ship shall be carried out during the interval between sunrise and sunset. The 24 hour quarantine service shall be applied to any port with conditions for a ship to navigate and call at or leave at night as well as for night-time loading and unloading. No quarantine inspection is applied at night to a ship coming from an infected area.

 

Article 30 The captain of a ship which is subject to entry quarantine, upon the embarkation of a quarantine doctor, shall deliver the Maritime Declaration of Health, the List of Crew Members and Passengers, and the Inventory of the Holds which shall be signed by him or countersigned by the ship’s surgeon, and produce the Deratting Certificate or the Deratting Exemption Certificate.

During the inspection, the quarantine doctor shall have the right to consult the journal of voyage and other related documents. When the quarantine doctor desires any further information as to the health condition on board during the voyage, he may make inquires of the captain and the ship’s surgeon. The captain and the ship’s surgeon shall reply truthfully to the above-mentioned inquiries orally. If in a written form, it shall be signed by the captain and countersigned by the ship’s surgeon.

 

Article 31 On completion of entry quarantine of a ship, the quarantine doctor shall grant a free pratique immediately to a healthy ship; if sanitary treatment or restrictions shall be applied to the ship,  they shall be specified in the pratique and implemented accordingly; a notification of sanitary treatment shall be given to an infected or suspected ship with the Harbour Superintendency Administration dully informed. The pilot and any other person on board the ship with permission of the health and quarantine organization shall be regarded as crew members and be subject to sanitary treatment. An entry pratique shall be issued thereafter.

Having obtained the entry pratique issued by the health and quarantine organization, the ship may lower the quarantine signal.

 

Article 32 Before the departure of any ship which is subject to departure quarantine, the Shipping Agency shall inform the health and quarantine organization as early as possible of the following:

1)     name and nationality of the ship and scheduled date and time of departure;

2)     port of destination, and first port of call;

3)     list of crew members and that of passengers;

4)     category of the cargo.

The Harbour Superintendency Administration shall inform the health and quarantine organization as early as possible of the exact time and date of the ship’s departure.

When quarantine inspection for entry and departure is to be carried out at the same port, the list of crew members and that of passengers may not be delivered in case that there is no change of crew members and passengers; if there is any change, a list of changed crew members and that of changed passengers shall be delivered.

 

Article 33 The captain of a ship which is subject to departure quarantine shall present to the health and quarantine organization the Deratting Certificate or the Deratting Exemption Certificate and other documents in relation to quarantine. The quarantine doctor may make inquires of the captain and the ship’s surgeon about the health condition of crew members and passengers and the sanitary conditions on board the ship, the captain and the ship’s surgeon shall reply in truth to such inquiries.

 

Article 34 After the departure quarantine of a ship has been completed; the quarantine doctor shall issue the quarantine certificate for departure of ship immediately according to the result of quarantine inspection. If any ship is unable to depart at the scheduled time on account of the sanitary treatment, the Harbour Superintendency Administration shall be dully informed.

 

Article 35  After the departure quarantine of a ship has been completed, no one, except the pilot and those permitted by the health and quarantine organization, shall be allowed to embark and no articles such as luggage, goods and postal parcels shall be loaded or unloaded.

The departure quarantine shall be reapplied to a ship in violation of the above-mentioned stipulations.

 

Part V

Aviation Quarantine

Article 36 No articles capable of causing a communicable disease shall be thrown out or allowed to fall from an aircraft when it is in flight.

 

Article 37 The airstation at the airport where quarantine inspection is applied shall, before the arrival of any aircraft which is subject to entry quarantine, inform the health and quarantine organization as early as possible of the following:

1)     nationality, type, number and symbol of the aircraft and scheduled time of arrival;

2)     airport of departure and transit airport;

3)     number of crew members and passengers.

 

Article 38 If a case of a quarantinable disease or a suspected quarantinable disease or a person died of an unidentified cause other than an accident on board the aircraft which is subject to entry quarantine is discovered during the flight, the captain of the aircraft shall immediately report through the airstation at the airport of arrival to the health and quarantine organization the following:

1)     nationality, type number and symbol of the aircraft and scheduled time of arrival;

2)     airport of departure and transit airport;

3)     number of crew members and passengers;

4)     name of the disease or main symptoms and number of cases and deaths.

 

Article 39 The quarantine doctor shall be the first to embark on the aircraft which is subject to entry quarantine upon its arrival at the airport. The captain of the aircraft or his representative shall deliver a general declaration, a passenger list, a cargo manifest and a valid mosquito destruction certificate or other documents in relation to quarantine to the health and quarantine organization. The captain or his representative shall reply in truth to the quarantine doctor’s inquiries about the sanitary conditions on board the aircraft. Without the permission of the health and quarantine organization, no person is allowed to embark or disembark, and no loading or unloading of luggage, goods and postal parcels is allowed before quarantine inspection is over.

 

Article 40 Any incoming passenger shall subject himself to entry quarantine inspection at the designated place and reply to relevant inquiries of the quarantine doctor orally or in written form, during which, no passenger is allowed to leave the designated area for quarantine.

 

Article 41 After inspection of an entering aircraft, the quarantine doctor shall grant a free pratique to a healthy aircraft according to the result of inspection. If sanitary treatment or restrictions shall be applied to the aircraft, they shall be specified in the pratique. The captain or his representative shall be responsible for their implementation; a notification of sanitary treatment shall be given to an infected or suspected aircraft with the airstation dully informed. A pratique for entry may be issued only after the specified sanitary treatment has been carried out.

 

Article 42 Before the departure of any aircraft which is subject to departure quarantine, the airstation at the airport where quarantine inspection is applied shall, as early as possible, submit to the health and quarantine organization a general declaration, a cargo manifest and other documents in relation to quarantine and inform the health and quarantine organization of the following:

1)     nationality, type, number and symbol of the aircraft and scheduled time of departure;

2)     transit airport and airport of destination;

3)     number of crew members and passengers.

 

Article 43 Any aircraft which has been inspected by the quarantine doctor shall be given the quarantine certificate for departure of aircraft either immediately or, in case of a healthy aircraft, after the completion of necessary sanitary treatment. If the aircraft is unable to take flight on the scheduled time due to sanitary treatment, the airstation shall be informed without delay.

 

Part VI

 Land Frontier Quarantine

Article 44 Before the arrival of a train which is subject to entry quarantine, the station where quarantine inspection is applied shall notify the health and quarantine organization as soon as possible of the following:

1)     number of the train and scheduled time of arrival;

2)     station of departure;

3)     grouping of the train.

 

Article 45 On arrival of a train or any other vehicle which is subject to entry quarantine at a station or at a frontier post, the quarantine doctor shall be the first to embark on the train or vehicle. The master of the train or the person in charge of the vehicle shall report to the health and quarantine organization the health condition of all persons on board the train or vehicle orally or in written form, and shall reply in truth to the inquiries of the quarantine doctor about the sanitary conditions of the train or vehicle and the health condition of the persons.

 

Article 46 On arrival of a train or any other vehicle which is subject to entry quarantine at a station or at a frontier post, no person is allowed to get on or off the train or vehicle, nor any luggage, goods and postal parcels are allowed to be loaded or unloaded without the permission of the health and quarantine organization before quarantine inspection is over and a pratique for entry issued.

 

Article 47 Before the departure of a train which is subject to departure quarantine, the station where quarantine inspection is carried out shall notify the health and quarantine organization as soon as possible of the following:

1)     number of the train and scheduled time of departure;

2)     station of destination;

3)     grouping of the train.

 

Article 48 If a quarantinable disease or a suspected quarantinable disease or a person died of an unidentified cause other than an accident on board a train or a vehicle which is subject to entry or departure quarantine is discovered during the journey, the master of the train or the person in charge of the vehicle shall, on arrival at the station or at the frontier post, notify the health and quarantine organization of the above-mentioned information.

 

Article 49 If a train which is subject to entry or departure quarantine is unable to depart on the scheduled time due to the discovery of a quarantinable disease or a suspected quarantinable disease during the inspection, or due to sanitary treatment, the health and quarantine organization shall inform the master of the station of the situation immediately; if it is inconvenient to apply sanitary treatment to the train at the place where the train is parked, the master of the station shall choose an appropriate place for this purpose. Before sanitary treatment is completed, no person shall be allowed to get on or off the train, or to load or unload such articles as luggage, goods and postal parcels without the permission of the health and quarantine organization.

In order to ensure the normal transportation of an inbound express train, the health and quarantine organization may send a quarantine doctor along with the train for quarantine inspection and the master of the train shall make things convenient for him.

 

Article 50 After the entry or departure quarantine of a train or any other vehicle, the quarantine doctor shall, according to the result of the inspection, issue to the train or the vehicle a pratique or quarantine certificate for departure either immediately or after the necessary sanitary treatment.

 

Article 51 Any traveler entering or leaving the country on foot shall be subject to entry or departure quarantine at the designated place, and shall not be allowed to leave the place without the permission of the health and quarantine organization.

 

Article 52 The sanitary inspection and necessary sanitary treatment shall be applied to a train or any other vehicle, which is subject to entry or departure quarantine, loaded with goods from an infected area, infected or suspected of infection, or carrying rodents and insect vectors capable of transmitting a communicable disease.

 

Part VII

Health Measures

Article 53 When applying sanitary treatment, the officers of the health and quarantine organization shall pay attention to the following:

1)     not to cause any injury to human health;

2)     not to produce any harmful effect on the structure or equipment of means of transport;

3)     to avoid any risk of fire; and

4)     to avoid any damage to luggage or goods.

 

Article 54 If any container, luggage, cargo, postal parcel or any other article carried into or out of the country requires sanitary treatment, it shall be conducted by the health and quarantine organization. Disinfection, deratting, disinsecting or other sanitary treatment shall be applied to any inbound and outbound means of transport by the health and quarantine organization if:

1)     it comes from an infected area of a quarantinable disease; or

2)     it is contaminated by a quarantinable disease; or

3)     it carries rodents or insect vectors in relation to human health exceeding the limit permitted by the national health standards.

 

Article 55 Goods transported from abroad for transit without transshipment within the territory of the People’s Republic of China shall not be subject to sanitary treatment unless an incident of epidemiological significance calling for application of sanitary treatment has occurred.

 

Article 56 The health and quarantine organization shall, according to the state of contamination, apply disinfection, deratting, disinsecting respectively to the waste and used articles carried into or out of the country or to the waste and used means of transport which once travelled outside the country. If seriously contaminated, it shall be cremated.

 

Articles 57 Any person or his agent undertaking transportation into or out of the country of a corpse or human remains shall apply for quarantine and produce a death certificate or other relevant documents. The health and quarantine organization shall apply sanitary treatment to any corpse of human remains not up to the sanitary requirements. Its removal into or out of the country may be allowed only after an entry or departure permit is issued. The corpse of a patient died of a qurantinable disease shall not be removed but cremated at the local place.

 

Article 58 The health and quarantine organization shall not repeat sanitary treatment which has been applied to the means of transport at a previous port unless:

1)     an incident of epidemiological significance calling for a further application of sanitary measures has occurred at the frontier port where the measures were applied or on the means of transport; or

2)     the sanitary measures applied at the previous frontier port were not substantially effective.

 

Article 59 If any abnormal death among rodents, the cause of which is not yet known, is found at a frontier port or on a means of transport, the relevant organization at the frontier port or the person in charge of the means of transport shall immediately report to the health and quarantine organization for rapid ascertainment of its cause and application of sanitary treatment.

 

Article 60 The captain of a ship for international voyage shall apply at an interval of six months to the health and quarantine organization for regular inspection of rats; the health and quarantine organization shall, according to the result of the inspection, apply a deratting to the ship or exempt it from deratting and issue a Deratting Certificate or a Deratting Exemption Certificate, which shall be valid for a period of six months reckoned from the date of issue.

 

Article 61 The health and quarantine organization may issue a Derattine Exemption Certificate if it is verified that a ship is free of rodents through inspection which has been carried out only when:

1)     the holds are empty; or

2)     the holds contain only ballast or other material unattractive to rodents, and so disposed as to make rats inspection possible.

A Deratting Exemption Certificate may be issued after inspection for an oil tanker with full holds.

 

Article 62 Wherever possible rats inspection or deratting of a ship shall be done when the holds are empty. If, for some reasons, rats inspection or deratting by means of fumigation cannot be conducted on the scheduled time, and the ship is proceeding to a port where measures of such kind would be facilitated, the health and quarantine organization may permit one month extension of the validity of the existing Deratting Certificate or the Deratting Exemption Certificate and issue the Extension Certificate.

 

Article 63 When a ship for an international voyage is subject to deratting by means of fumigation according to the criteria provided for by the state, even if the Deratting Certificate of the Deratting Exemption Certificate of the ship is still valid, except that the ship is infected or suspected with plague, the health and quarantine organization shall notify the captain of the ship of the reasons for such treatment. The captain of the ship shall act on the requirements.

 

Article 64 The captain of a ship anchoring at a port shall be responsible for the following measures:

1)     effective rat-proofing boards or other such facilities shall be used on the ropes;

2)     ladders and gangboards shall be illuminated with spot-lamps at night;

3)     the health and quarantine organization shall be notified when dead rats are found or rodents are caught on board the ship.

 

Article 65 If a ship for an internal voyage anchoring at a frontier port is infested with rats, deratting shall be carried out by the ship side; it may also be conducted by the health and quarantine organization if so requested.

 

Article 66 The National Health Administration under the State Council may, if it deems necessary, require any person from abroad or from some foreign areas, on entering the territory, to produce a valid certificate of vaccination against a certain disease or a health certificate to the health and quarantine organization.

 

Article 67 The valid period of vaccination is as follows:

1)     for yellow fever, ten years beginning ten days after the date of vaccination or, in the event of a revaccination within such period of ten years, from the date of that revaccination;

2)     the valid period of other vaccinations shall be governed by the relevant stipulations.

 

Part VIII

Control of Quarantinable Diseases

Chapter I

Plague

 

Article 68 The incubation period of plague is six days.

Articles 69 A ship or an aircraft shall be regarded as infected on arrival if:

1)     it has a case of human plague on board; or

2)     a plague-infected rodent is found on board; or

3)     a case of human plague has occurred on board more than six days after embarkation.

 

Article 70 A ship shall be regarded as suspected on arrival if:

1)     it has no case of human plague on board, but such a case occurred on board within the first six days after embarkation; or

2)     there is evidence of an abnormal death among rodents on board, the cause of which is not yet known.

 

Article 71 On arrival of an infected ship or aircraft, the following health measures shall be applied:

1)     isolation of any infected person;

2)     disinsecting of any suspect and medical examination on the spot or under observation for a period of not more than six days reckoned from the date of arrival; during this period, no member of the crew on board the ship, except for duty and permitted by the health and quarantine organization, shall be allowed to disembark;

3)     disinsecting and, if necessary, disinfection of any luggage and used articles of an infected person or a suspect and of any other article which the health and quarantine organization has reason to believe to be contaminated;

4)     disinsecting and, if necessary, disinfection of any part of the ship or aircraft having been occupied by an infected person and of any other part which the health and quarantine organization has reason to believe to be contaminated;

5)     the health and quarantine organization shall derat a ship or an aircraft where a rodent plague is found on board and may also derat it if only uninfected rodent is found on board. The deratting may be carried out in quarantine. The deratting of a ship shall be carried out before unloading;

6)     the unloading of a ship shall be carried out under supervision of the health and quarantine organization and precautions shall be taken to prevent the unloading staff from being infected. If necessary, medical examination on the spot or under observation may be applied to the unloading staff for a period of not more than six days reckoned from the date of the end of unloading.

 

Article 72 A suspected ship shall be subject to sanitary treatment provided for from paragraphs (2) to (6) inclusive in Article 71 of these specific rules.

 

Article 73 On arrival of a healthy ship or aircraft coming from an infected area, the health and quarantine organization may, if it considers necessary, apply the following sanitary treatment:

1)     placing any suspect who disembarks on medical examination on the spot or under observation for a period of not more than six days, reckoned from the date on which the ship or aircraft left the infected area;

2)     deratting of the ship or aircraft in exceptional cases.

 

Article 74 On arrival of a train or any other vehicle, on which a case of human plague has occurred, the following sanitary treatment shall be applied:

1)     application of the sanitary treatment provided for in paragraphs (1),(3), (4) and (6) in Article 71 of these specific rules;

2)     disinsecting of any suspect and medical examination on the spot or under observation for a period of not more than six days reckoned from the date of arrival;

3)     deratting, if necessary, of the train or other vehicle.

 

Chapter II

Cholera

 Article 75 The incubation period of cholera is five days.

 

Article 76 A ship shall be regarded as infected on arrival if it has a case of cholera on board, or if a case of cholera has occurred on board within five days before its arrival.

A ship shall be regarded as suspected if a case of cholera has occurred on board during the voyage, but no fresh case has occurred during a period of five days before its arrival.

 

Article 77 An aircraft shall be regarded as infected on arrival if it has a case of cholera on board.

An aircraft shall be regarded as suspected if a case of cholera has occurred on board during the voyage but has previously disembarked.

 

Article 78 On arrival of an infected ship or aircraft, the following health measures shall be applied:

1)     isolation of any infected person;

2)     medical examination on the spot or under observation for the crew members or passengers who disembark for a period of not more than five days reckoned from the date the completion of sanitary treatment; during a period of five days reckoned from the date of arrival, no member of the crew on board the ship, except for duty and permitted by the health and quarantine organization, shall be allowed to disembark;

3)     disinfection of any luggage and used articles of an infected person or a suspect, and of any other article or food which is considered to be contaminated;

4)     disinfection of any part of the ship or the aircraft which has been occupied by an infected person and of any other part which is considered to be contaminated;

5)     removal, after disinfection, of contaminated drinking water or any drinking water considered to be contaminated; no sanitary drinking water shall be replaced until the containers are disinfected;

6)     human dejecta, garbage, waste water and waste matter and bilge-water taken in from an infected area shall not be discharged or unloaded without disinfection;

7)     the unloading of a ship shall be carried out under supervision of the health and quarantine organization and precautions shall be taken to prevent the unloading staff from being infected. If necessary, medical examination on the spot and under observation may be applied to the unloading staff for a period of not more than five days reckoned from the date of the end of unloading.

 

Article 79 The following sanitary measures shall be applied to a suspected ship or aircraft:

1)     application of the sanitary measures provided for in paragraphs (2) to (7) inclusive in Article 78 of these specific rules;

2)     medical examination on the spot or under observation for a period of not more than five days reckoned from the date of his arrival shall be applied to the crew members or passengers who disembark; during this period, no member of the crew on board the ship, except for duty and permitted by the health and quarantine organization, shall be allowed to disembark; medical examination on the spot or under observation may also be applied to the crew members or passengers who disembark for a period of not more than five days reckoned from the date of his leaving the infected area.

 

Article 80 On arrival of a healthy ship or aircraft coming form infected area, the health and quarantine organization may, if it considers necessary, take the following sanitary measures:

1)     applying the sanitary measures provided for in paragraphs (5) and (6) in Article 78 of these specific rules;

2)     placing any crew member or passenger who disembarks examination on the spot or under observation for a period of not more than five days reckoned form the date of his leaving the infected area.

 

Article 81 On arrival of a train or any other vehicle, on which a case of cholera has occurred, the following sanitary measures shall be applied:

1)     application of the health measures provided for in paragraphs (1), (3), (5) and (7) in Article 78 of these specific rules;

2)     medical examination on the spot or under observation shall be applied to any suspect for a period of not more than five days reckoned form the date of his arrival.

 

Article 82 The health and quarantine organization may, if it considers necessary, apply disinfection and disinsecting to the means of transport coming from cholera infected area or suspected of cholera infection; any aquatic products, fruit, vegetables, beverage or other foodstuffs on board the means of transport shall not be allowed to be unloaded without the permission of the health and quarantine organization, unless such food or beverage is in sealed containers and not contaminated; if necessary, sanitary measures may be applied to them.

 

Article 83 During the inspection, the health and quarantine organization may take samples for testing of aquatic products, fruit, vegetables, beverage or postal parcels containing such food products and beverage from an infected area in order to ascertain whether the above-mentioned articles have been contaminated. Sanitary measures may be applied if necessary.

 

Chapter III

Yellow Fever

Article 84 The incubation period of yellow fever is six days.

 

Article 85 Any person coming form an infected area, on entering the territory, shall produce a valid certificate of vaccination against yellow fever to the health and quarantine organization.

The health and quarantine organization may place under observation a person without a valid certificate of vaccination against yellow fever for a period of six days reckoned from the date of his leaving the infected environment or vaccinate him and place him under observation until his certificate becomes valid.

 

Article 86 An aircraft shall be regarded as infected on arrival if it has a case of yellow fever on board.

 

Article 87 On arrival, an aircraft from yellow fever infected area shall produce a certificate of destruction of mosquitoes demonstrating that destruction of mosquitoes had been carried out immediately before it took off from that area; if, on arrival, it is unable to produce a certificate of destruction of mosquitoes, or if the health and quarantine organization is not satisfied with the certificate and finds live mosquitoes on board, the aircraft shall be regarded as suspected of yellow fever infection.

 

Article 88 On arrival, a ship shall be regarded as infected if it has a case of yellow fever on board, or if a case has occurred on board during its voyage.

A ship shall be regarded as suspected if it has left an infected area less than six days before arrival, or if arriving within thirty days of departure from such area, Aedes aegypti or other vectors of yellow fever are found on board.

 

Article 89 The following health measures shall be applied to an infected ship or aircraft:

1)     isolation of any infected person;

2)     application of health measures provided for in Article 85 of these specific rules to any passenger or member of the crew who disembarks and is not in possession of a valid certificate of vaccination against yellow fever;

3)     destruction of any Aedes aegypti, their eggs and larva, and other vectors of yellow fever on board; and restriction of the ship to keep at least 400 meters from land and other ships until it has been disinsected;

4)     the unloading of the ship shall be carried out after it has been disinsected, or under the supervision of the health and quarantine organization before disinsecting, and precautions shall be taken to prevent the unloading staff from being infected; if necessary, medical examination on the spot or under observation for a period of six days, reckoned from the date of the completion of unloading, may be applied to the unloading staff.

 

Article 90 A suspected ship or aircraft shall be subject to the health measures provided for from paragraphs (2) to (4) inclusive in Article 89 of these specific rules.

 

Article 91 The health and quarantine organization, if it deems necessary, may apply the health measures provided for in paragraph 3 in the Article 89 of these specific rules to a healthy ship or aircraft which has come from yellow fever infected area.

 

Article 92 For any train or other vehicle with a case of yellow fever on board on arrival or coming from an infected area, the health measures provided for in paragraphs (1)and (4) in Article 89 of these specific rules shall be applied; and complete destruction of mosquitoes, their eggs and larva shall be carried out. The health measures provided for in Article 85 shall be applied to any crew member or passenger without a valid certificate of vaccination against yellow fever.

 

Chapter IV

Medical Examination on the Spot, under Observation and Isolation

Article 93 The health and quarantine organization shall issue to the person subject to medical examination on the spot a record of surveillance for that purpose; if necessary, the record of surveillance may be issued to him after he has given a written pledge for fulfilling medical examination on the spot.

The person subject to medical examination on the spot shall, carrying the record of surveillance with him be examined medically at the time and place designated by the health and quarantine organization; if the result of medical examination on the spot is healthy, he shall return the record of surveillance to the health and quarantine organization when the period of medical examination on the spot expires.

 

Article 94 The health and quarantine organization shall, by the promptest means, communicate the information about the person subject to medical examination on the spot to its counterpart or any other medical and health institution at the place where the above-mentioned person is to make a stop.

When a heath and quarantine organization or a medical and health institution is visited by a person subject to medical examination on the spot, he shall be treated as an emergency case, the result of the medical examination shall be registered in the record of surveillance; if he is found to be infected by a quarantinable disease, or a communicable disease under surveillance, or a suspected quarantinable disease or a suspected communicable disease under surveillance, necessary health measures shall be adopted immediately; the record of surveillance shall be taken back from him and kept for reference; and local health and epidemic prevention institution and the health and quarantine organization which has issued the record of surveillance shall be dully informed.

 

Article 95 Any person subject to observation shall be placed under observation at the place designated by the health and quarantine organization; but with the consent of the health and quarantine organization, he may be placed under observation on board a ship if:

1)     the captain requests that member of the crew be thus treated on board;

2)     the passenger himself requests, with the captain’s permission, to be treated on board, and a ship’s surgeon and facilities for medical treatment and disinfection are available on board the ship.

 

Article 96 If symptoms indicative of a quarantinable disease appear in a person under observation during the period of observation, the health and quarantine organization shall immediately put him in isolation; other persons under observation in contact with him shall be subject to necessary sanitary treatment; their period of observation shall be reckoned from the time the sanitary treatment is completed.

 

Part IX

Surveillance of Communicable Diseases

Article 97 Any means of transport, person, food, drinking water and other articles for entry into or exit from the country as well as insect vectors and animals shall be subject to communicable disease surveillance.

 

Article 98 The surveillance of communicable diseases contains:

1)     investigation on each index case;

2)     epidemiological survey on the outbreak of diseases;

3)     investigation on the source of infection;

4)     retrospective study of the diseases under surveillance inside frontier ports;

5)     isolation and identification of pathogens, seriological and epidemiological investigation on human groups and animals concerned;

6)     investigation on related animals, insect vectors, food, drinking water and environmental factors;

7)     observation and evaluation of the result of disinfection, deratting and disinsecting;

8)     collection, collation, analysis and transmission of epidemiological information on communicable diseases under surveillance at frontier ports and at home and abroad;

9)     physical examination of target population under surveillance and control of infected persons, suspects and close contacts of communicable diseases under surveillance.

 

Article 99 The health and quarantine organizations shall prevent any foreigner suffering from AIDS, venereal disease, leprosy, psychiatric disorder or open pulmonary tuberculosis from entering the territory.

 

Article 100 A person subject to entry or departure quarantine shall, as required by the quarantine doctor, fill in the health declaration form truthfully and produce a valid certificate of vaccination against certain communicable disease or a health certificate or other relevant documents.

 

Article 101 The health and quarantine organizations shall apply surveillance of communicable diseases to all persons for entry into or exit from the country, staying in the hotels or guest houses with service to foreigners at a frontier port and to the staff members of such hotels any guest houses and shall take necessary preventive or control measures according to various situations.

The quarantine doctor may, according to the result of epidemiological and medical examination, provide any person coming from an infected area of a quarantinalbe disease or a communicable disease under surveillance with a “FOR YOUR HEALTH” card.

When a health and quarantine organization or a medical and health institution is visited by a person in possession of a “FOR YOUR HEALTH” card applying for medical examination, he shall be treated as an emergency case. If he is found to be infected with a quarantinable disease, or a communicable disease under surveillance, or a suspected quarantinable disease, or a suspected communicable disease under surveillance, necessary health measures shall be adopted immediately; the local health and epidemic prevention institution and the health and quarantine organization which has issued the “FOR YOUR HEALTH” card shall be informed of the situation.

 

Article 102 Any person of Chinese nationality applying to stay abroad for more than one year shall be in possession of a health certificate issued by the health and quarantine organization. The Exit-Entry Administration for Chinese citizens shall handle the exit formalities based on the above-mentioned certificate.

Any person of Chinese nationality having stayed abroad for more than one year shall, on entering the territory, declare his health conditions to the health and quarantine organization and undergo physical examination in a nearby health and quarantine organization or in a hospital at or above the county level within one month beginning from the date of his arrival. The Public Security Office shall handle the relevant formalities based on the health certificate. The duplicate of his health certificate shall be mailed for reference to the health and quarantine organization at the frontier port from which he entered.

Any crew member of Chinese nationality on the means of transport for international voyage shall be in possession of a health certificate issued by the health and quarantine organization or by a hospital at or above the county level. The items and form of the health certificate shall be specified by the National Health Administration under the State Council. The validity of the certificate extends for a period of 12 months.

 

Article 103 When the health and quarantine organization establishes a communicable disease surveillance post inside the frontier port, the organizations concerned shall provide it with assistance and facilities.

 

Part X

Sanitary Supervision

Article 104 The health and quarantine organization shall conduct sanitary supervision over the frontier port and the means of transport in accordance with provisions contained in Articles 18 and 19 of the Frontier Health and Quarantine Law of the People’s Republic of China.

 

Article 105 The sanitary requirements for the frontier ports are:

1)     any frontier port and any hotel, service trade and terminal hall for ship, train or aircraft for foreigners thereat shall have sound sanitary rules and necessary sanitary facilities; they shall be kept clean indoors and outdoors and well-ventilated;

2)     any relevant organization at a frontier port shall take appropriate measures to control rodents and insect vectors and minimize their number to the state of  causing no infestation; warehouses and freightyards shall be equipped with rat-proofing devices;

3)     all garbage, wastes, waste water and dejecta at any frontier port shall be treated innocuously so as to keep the surroundings clean and healthy at the frontier port.

 

Article 106 The sanitary requirements for the means of transport are:

1)     cabins and compartments on any means of transport shall be kept clean and healthy and well-ventilated;

2)     any means of transport shall be equipped with adequate disinfectant, insecticide and rodenticide and facilities as well as rat-proofing devices;

3)     cargo holds, luggage cabin or goods vans on any means of transport shall be thoroughly cleaned before loading and after unloading; toxic articles shall not be mixed with food so as to prevent contamination;

4)     any inbound or outbound means of transport, not up to the sanitary criteria, shall, under the supervision and direction of the health and quarantine organization, improve its sanitary conditions immediately.

 

Article 107 The sanitary requirements for food and drinking water and for food and drinking water handlers are:

1)     any food and drinking water at a frontier port or on a means of transport shall be up to the relevant hygienic standards;

2)     any hotel with service to foreigners at a frontier port and any unit providing food and drinks to an inbound or outbound means of transport shall, before starting its business, apply to the health and quarantine organization for a health permit;

3)     any food or drinking water handler at any hotel with service to foreigners at a frontier port or on any inbound or outbound means of transport shall be in possession of a health certificate issued by the health and quarantine organization. The validity of such certificate extends for a period of 12 months reckoned from the date of issue.

 

Article 108 The organizations concerned at the frontier ports and the persons in charge of the means of transport shall comply with the following:

1)      observance of the stipulations specified in the Frontier Health and Quarantine Law and these specific rules as well as in other related health laws and regulations;

2)      acceptance of supervision and inspection by sanitary supervisors and provision of convenience for their work;

3)      adoption of timely measures for the improvement of sanitary conditions at the frontier ports and on the means of transport in accordance with the proposals made by sanitary supervisors.

 

Part XI

Penalty

Article 109 The offences which shall be subject to disciplinary sanctions specified in the Frontier Health and Quarantine Law and in these specific rules refer to:

1)     any ship subject to entry quarantine but no quarantine signal hoisted; or

2)     any inbound or outbound means of transport, before entry quarantine or after departure quarantine, embarking or disembarking any person or loading or unloading any luggage, without the permission of the health and quarantine organization; or

3)     refusal of quarantine inspection or sanitary supervision, or rejection of sanitary treatment;

4)     forgery and alteration of quarantine forms and certificates, or failure to report the epidemic situation truthfully;

5)     concealment, in reporting, of those microbes, human tissues, biological products, blood and blood products which are prohibited from being carried into the territory, or other animals and articles likely to transmit a communicable disease;

6)     any means of transport which has not yet been quarantined departing the inspection area without authorization for evading quarantine inspection;

7)     withholding of epidemic situation or fabrication of its circumstances;

8)     discharge of ballast water and disposal of garbage and wastes under  control without prior application of sanitary treatment by the health and quarantine organization;

9)     removal or transportation, without authorization, of a corpse or human remains before sanitary treatment by the health and quarantine organization;

10) importation or exportation, or use or break-up of waste and used articles or waste and old means of transport without declaration to and sanitary treatment and issuance of quarantine certificate by the health and quarantine organization; and

11)Removal of a case of a communicable disease from the means of transport without inspection of the health and quarantine organization, resulting in the risk of transmission of a communicable disease.

 

Article 110 A warning or a fine of one hundred to five thousand yuan shall be imposed for each offence listed from paragraphs (1) to (5) in Article 109 of these specific rules;

A fine of one thousand to ten thousand yuan shall be imposed for each offence listed from paragraphs (6) to (9) in Article 109 of these specific rules;

A fine of five thousand to thirty thousand yuan shall be imposed for each offence listed in paragraphs (10) and (11) in Article 109 of these specific rules.

 

Article 111 On levying a fine, the health and quarantine organization shall give an official receipt. All the fines shall be turned over to the state treasury.

 

Part XII

Appendix

Article 112 The standard charges for health and quarantine service by the health and quarantine organization shall be determined by the National Health Administration under the State Council together with the Finance Administration and the Price Administration under the State Council.

 

Article 113 The interpretation of these specific rules is exclusively with the National Health Administration under the State Council.

 

Article 114 These specific rules shall come into force as from the date of publication.
