1. General regulation

The RF Government approved a list of oils and fats and products made of them subject to getting obligatory certificates of conformity. The oils and fats and the products with the following tariff heading numbers are included in the list: 1507, 1508, 1509, 1510 00, 1511, 1512, 1513, 1514, 1515, 1516 20, 1517 18 06, 2103 90 900 1, 2103 90 900 9, 2106 90 980 4, 1520 00 000, 2905 45 000 1, 2905 45 000 9, 3401 19 000 0, 34101 20.

2. Export regulation

2.1. Non-tariff measures

President passed a decree “On making amendments in the RF President decree №312 of March 27, 1992 “On control over export of nuclear materials, equipment and technologies from Russia”. The decree stipulates that nuclear materials and technologies may be exported to India, only if they are to be applied in the nuclear installations under control of the International Agency on atomic energy. Besides, nuclear goods and technologies may be exported to countries not having nuclear weapons officially, including India, only after getting assurance of the corresponding bodies of an importer country that exported goods and technologies as well as products made of them must not be used for producing nuclear weapons.

2.2. Tariff measures

Since February 1, 2009 the rate of export customs duty on crude oil and raw oil products (2709) produced of bituminous rocks and exported from the RF territory outside the borders of the Customs Union member states was set at USD 100.9 per a ton compared to USD 119.1 per a ton before. The rate was fixed at USD 115.3 per a ton from March 1, 2009 and at USD 110 per a ton from April 1, 2009.

Since February 1, 2009 the basic rate of export customs duty on the main light oil products and liquefied oil gases (tariff heading numbers 2710 11 – 2710 19490, 2711 12 – 2711 19 000 0, 2902 20 000 0 – 2902 43 000 0) was set at USD 80.3 per a ton compared to USD 92.6 per a ton in January 2009. The rate on the dark oil products (tariff heading numbers 2710 19 510 0 – 2710 99 000 0, 2712 and 2713) was set at USD 43.2 per a ton as compared with USD 49.9 per a ton in January 2009.

The rate on the main light oil products and liquefied oil gases went up to USD 90 per a ton from March 1, 2008 and at USD 86.4 per a ton from April 1, 2009, while the rate on the dark oil products was set at USD 48.5 and USD 46.5 per a ton, accordingly (Russian Government resolutions № 1023, December 25, 2008, №66, January 29, 2009, №143, February 24, 2009, №256, March 26, 2009)

The RF Government passed a resolution “On rates of export customs duties on the certain kinds of round wood and timber exported from the RF territory’ outside the Customs Union member countries”. Resolution #982 came into effect since January 1, 2009 and delay rise in the rates on soft wood until 2010. In particular, soft round wood with tariff heading numbers 4403 20 110 1, 4403 20 110 2, 4403 20 190 1, 4403 20 190 9, 4403 20310 1, 4403 20310 2, 4403 20 390 1, 4403 20 390 9, 4403 20 910 1, 4403 20 910 2, 4403 20 910 3, 4403 20 910 4, 4403 20 910 9, 4403 20 990 1, 4403 20 990 9, 4403 99 510 1, 4403 99 510 2, 4403 99 590 9 will be levied with the rate 25% of customs value but not less than EURO 3 5 per 1 cubic meter beginning with January 1, 2009 and 80% of customs value but not less than EURO 50 per 1 cubic meter from January 1, 2010. This means import customs duty rates on these kinds of round wood in 2009 remain the same as in April-December 2008, and the higher rates will come into effect in 2010 only.

Round wood with tariff heading numbers 4403 99 100 0, 4403 99 300 0, 4403 99 950 2 will be levied with the rate 10% of customs value but not less than EURO 5 per 1 cubic meter from January 1, 2009, as before. Beginning with January 1, 2010 these kinds of round wood will be levied with the rate 80% of customs value but not less than EURO 50 per 1 cubic meter.

On the contrary, hard round wood and timber with tariff heading numbers 4403 10 000 1, 4403 10 000 2, 4403 10 000 3, 4403 10 000 9, 4403 91 100 0, 4403 91 900 0, 4403 92 100 0, 4403 92 900 0, 4403 99 950 1, 4403 99 950 9, 4407 91 900 0, 4407 92 000 0, 4407 93 900 0, 4407 94 900 0, 4407 95 900 0 will be levied with the rate at EURO 100 per 1 cubic meter from January 1, 2009 compared to 20% of customs value, but not less than EURO 24 per 1 cubic meter or 10% of customs value but not less than EURO 5, EURO 10, EURO 12 per 1 cubic meter or 0% of customs value before. The RF Government set new export customs duties on refined copper cathodes and their sections (7403 11 000 0) and non-alloyed nickel (7502 10 000 0) at the rate 0% of customs value since early February 2009 compared to 10% and 5% of customs value before, accordingly. (Russian Government resolution №25, January 21, 2009).

Since February 1, 2009 export customs duties on nitrogenous fertilizers (3102) and on complex fertilizers (3105) have been fixed at the rate 0% of customs value compared to 8.5% of customs value before. (Russian Government resolution №65, January 27, 2009)

3. Import regulation

3.1. Non-tariff measures

The RF Government passed a resolution on distributing tariff quotas on imports of beef and pork and on distributing quotas on imports of poultry meat for 2009.

The RF Government set tariff quotas on imports of beef and pork and quotas on imports of poultry meat for 2009. The total tariff quota on imports of frozen beef (0202) went up by 5000 tons from 445000 t in 2008 to 450000 t, including 355500 t from the EU, 18500 t from the USA, 3000 t – from Paraguay, 73000 t – from other countries. The total tariff quota on imports of pork, including trimming (0203) went up by 8700 tons from 523200 t to 531900 t, including 253400 t from the EU, 100000 t from the USA, 1000 t from Paraguay and 177500 t from other countries. The total tariff quota on imports of fresh or cooled beef (0201) rose by 600 tons from 28900 t to 29500 t, including 29000 t from the EU and 500 t from other countries. The total quota on imports of poultry meat (0207) went down by 259600 tons from 1211600 t in 2008 to 952000 t in 2009, including 185800 t from the EU, 750000 t from the USA, 3800 t from Paraguay and 12400 t from other countries.

These quotas are not in effect on imports of meat from the CIS countries. (Russian Government resolution №105, February 14, 2009)

The RF Government increased tariff quotas on imports of beef and pork and quotas on imports of poultry meat in 2008 compared to 2007.

In particular, the total tariff quota on imports of frozen beef (0202) went up by 5000 tons from 440000 t in 2007 to 445000 t, on imports of pork (0203) – by 8700 tons from 484800 t to 493500 t, on imports of fresh or cooled beef (0201) – by 600 tons from 28300 t to 28900 t, on imports of poultry meat (0207) – by 40400 tons from 1171200 t to 1211600 t, accordingly. Resolution #14 came into effect since February 23, 2008. (Russian Government resolution №14, January 19, 2008)

Federal Customs Service reminded that the ecological standard “EURO 3” on exhausting gases of automobiles, including import ones, came into effect since January 1, 2008 according to the RF Government resolution №609 of October 12, 2005. 3.2. Tariff and tax measures

The RF Government passed resolution #918 of December 8, 2008 “On temporary rates of import customs duties on the certain kinds of beef, pork and poultry meat and on making amendments in its resolution #732 of December 5, 2005”. Resolution #918 came into effect since January 1, 2009.

The temporary rates of import customs duties on the certain kinds of beef are extended for 2009. The rate on beef (0201, 0202) to be imported above the tariff quota is set at 30% of customs value, but not less than EURO 0.3 per 1 kg as in 2008. The rate on pork (0203) to be imported above the tariff quota is set for 2009 at 75% of customs value but not less than EURO 1.5 per 1 kg instead of 60% of customs value but not less than EURO 1 per 1 kg stipulated for 2008. Accordingly, the rate on poultry meat (0207) to be imported above the import quota is set at 95% of customs value but not less EURO O.8 per 1 kg instead of 60% of customs value but not less than EURO 0.48 per 1 kg stipulated for 2008. Since January 16, 2009 the temporary import customs duties have been set on natural rubber (4001 22 000 0 and 4001 29 000 0) at the rate 0% of customs value for the period of 9 months until September 15, 2009. Prior to it, the constant import customs rate on this natural rubber had been 5% of customs value. (Russian Government resolution №936, December 10, 2008)

The RF Government passed resolution “On making amendments in the RF Customs Tariff in respect of the certain kinds of flat cold rolled steel”. In particular, flat cold rolled steel (7209 17 900 1 and 7209 27 900 1) to be used for industrial assembly of automobiles (8701-8705) are levied with the temporary zero rate for the period of 9 months from February 24, 2009 until November 24, 2009. Flat cold rolled steel (7209 17 900 9 and 7209 27 900 9) to be used for the other purposes are levied with the rate 5% of customs value, as before. The RF Government extended temporary rates of import customs duties at the size of 0% of customs value on the certain polycarbonates (3907 40 000 1) and at the size 10% of customs value on the other polycarbonates (3907 40 000 9) from October 17, 2008 for the period of 9 months. (Russian Government resolution №963, December 19.2008)

Since January 14, 2009 new constant import customs duties have been set on computer controlled scissors, including presses, for cutting rolled flat steel with width not more than 0.35 mm for electric technical devices (8462 31 000 1) and on computer controlled punching and cutting out machines, including presses, for producing plates of the mentioned steel for transformers (8462 41 100 2). The new rates are 0% of customs value compared to 10% of customs value before. (Russian Government resolution №1082, December 31, 2008)

The RF Government passed a resolution on setting temporary rates of import customs duties on the certain civil airplanes since March 14. 2009 for the period of 9 months. The temporary rate on civil airplanes with net weight 2-15 tons and with seats for not more than 50 passengers (8802 30 000 1) and on other civil planes with net weight 2-15 tons passengers (8802 30 000 2) is set at 0% of customs value.

Prior to March 14, 2009 the constant rate of import customs duties on these airplanes had been 20% of customs value. (Russian Government resolution №1093, December 31, 2008)

New constant import customs duties have been set on the certain kinds of machines, equipment, devices and their parts since January 14, 2009. The rate at 5% of customs value is set on the following machines, equipment, devices and their parts: 8405 90 000 0, 8422 19 000 0, 8425 39 900 2, 8426 12 000 0, 8426 19 000 0, 8426 49 009 0, 8426 91 100 9, 8426 91 900 9, 8426 99 000 0, 8428 10 800 0, 8430 10 000 0, 8430 50 000 9, 8430 61 000 0, 8430 69 000 3, 8430 69 000 8. Prior to it, the constant rates had been 10% of customs value.

Since February 14, 2009 the RF Government set temporary import customs duties for the period of 9 months on the certain rolled steel and steel pipes. The rates are raised up to 15% and 20% of customs value compared to 5-10% and 10-15% of customs value before, accordingly.

The constant rates of import customs duties are set on the certain completing parts imported for producing automobiles instead of the temporary ones from February 14, 2009. The rate at the size 0% of customs value is set on rolled flat corrosion resistant steel, containing less than 2.5% of nickel and with thickness 0.35-3 mm for producing automobiles (7220 20 490 1). The rates at 5% of customs value are set on other rolled flat corrosion resistant steel containing less than 2.5% of nickel and with thickness 0.35-3 mm (7220 20 490 9), rolled flat corrosion resistant steel containing less than 2.5% of nickel and with thickness not more than 0.35 mm (7220 20 890 0), hermetic or semi-hermetic compressors for producing automobiles (8414 30 810 5). The rate at 15% of customs value remains on the compressors (8414 30 810 6, 8414 30 810 7 and 8414 3 0 810 9). Prior to March 12, 2008 the constant import customs duty rates on these goods had been 5%-15% of customs value, (Russian Government resolution №10, January 9, 2009)

The RF Government made amendments in the RF Customs Tariff in respect of the certain wagons for high speed electric trains with speed not less than 250 km per an hour. The temporary rates of import customs duties are set on these wagons (8603 10 000 I and 8605 00 000 1) at the size 0% of customs value for 9 months since February 14, 2009 compared to 5% and 10% of customs value before, accordingly. The other wagons (8603 10 000 9 and 8605 00 000 9) are levied with the rate 5% of customs value as against 5% and 10% of customs value before, accordingly. The RF Government set temporary import customs duty rate on the certain kinds of grain harvesting combines (8433 51 000 1, 8433 51 000 9, 8433 59 110 1 and 8433 59 110 9) at the size 15% of customs value but not less than EURO 120 per 1 kilowatt of their engine capacity since February 14, 2009 for the period of 9 months. Prior to July 26, 2007, the constant import customs duty rate on these combines had been EURO 70 per 1 kilowatt of engine capacity of the second hand combines or 5% of customs value but not less than EURO 100 per 1 kilowatt of engine capacity of the new combines. The RF Government set temporary import customs duties on the certain parts to be imported for industrial assembly of automobiles and tractors since April 4, 2009 for the period of 9 months. The new zero rates are set on the goods with the following heading numbers: 8407 34 990 2, 8407 90 900 1, 8408 20 310 1, 8408 20 350 1, 8408 20 370 1, 8408 20 510 2, 8408 20 550 2, 8408 20 571 1, 8408 20 579 1, 8408 20 990 2, 8708 10 900 1, 8708 21 900 1, 8708 29 900 i, 8708 40 200 9, 8708 40 500 1, 8708 40 600 1, 8708 50 300 1, 8708 50 500 1, 8708 50 700 1, 8708 70 500 1, 8708 70 910 1, 8708 70 990 J, 8708 80 150 9, 8708 80 300 2, 8708 80 400 3, 8708 80 500 1, 8708 91 200 9, 8708 91 300 1, 8708 91 500 1, 8708 92 200 9, 8708 92 300 1, 8708 92 500 1, 8708 94 200 9, 8708 94 300 1, 8708 94 500 1, 8708 95 500 1, 8708 99 910 I. Temporary import customs duty is set on soybean oil cake (2304 00 000 1) at the rate 5% of customs value since March 6, 2009 for the period of 9 months. Prior to it, the constant rate had been 0% of customs value. (Russian Government resolution №70, January 31, 2009)

The RF Government set temporary import customs duty on butter and other fat made of milk (0405) at the rate 15% of customs value but not less than EURO O.35 per 1 kg since March 6, 2009 for the period of 9 months. Prior to it, the constant rate had been 15% of customs value but not less than EURO O.22 per 1 kg. (Russian Government resolution №71, January 31, 2009)

Since March 6, 2009 the RF Government also set temporary’ fate on milk and cream, condensed or sweetened (0402, except 0402 29 110 0) at the rate 20% of customs value for the period of 9 months. Prior to March 6, 2009 the constant rate on these goods had been 15% of customs value. (Russian Government resolution №72, January 31, 2009)

Temporary import customs duty is set on the oil and gas pipes with concrete cover (7305 11 000 4) at the rate 0% of customs value since April 17, 2009 for the period of 9 months compared to the constant rate 15% of customs value before. (Russian Government resolution №99, February 10, 2009)

The RF Government set temporary import customs duty on foaming polystyrol (3903 11 000 0) at the rate 0% of customs value since March 20, 2009 for the period of 9 months. Prior to it, the constant rate on this polystyrol had been 5% of customs value. (Russian Government resolution №116, February 14, 2009)

The RF Government set constant import customs duties on the equipment for filling and closing vessels with medical substances and for packing medicines (8422 30 001 and 8422 40 000 1) at the rate 0% of customs value instead of the temporary’ import customs duties at the same rate since March 1, 2009. Prior to May 29, 2008 the constant rates on these kinds of equipment had been 5% of customs value. (Russian Government resolution № 144, February 24, 2009)

The amendments in the RF Customs Tariff are made in respect of the certain asynchronous electric engines. In particular, the asynchronous electric engines with capacity not more 750 wt and capacity from 750 watt up to 7.5 kilowatt (8501 51 000 1 and 8501 52 200 1) are to be levied with the temporary rate 10% of customs value but not less than EURO 10 or EURO 20 per a unit, accordingly, for the period of 9 months since May 3, 2009. Prior to it, the constant rate on these engines had been 0% of customs value. (Russian Government resolution №152, February 24, 2009)

The RF Government set seasonal import customs duty on rice, rice meal, granules, flakes and starch (1006, 1103 19 500 0, 1103 20 500 0, 1104 19 910 0 and 1108 19 100 0) at the rate EURO O. 16 per 1 kg since February 15, 2009 until May 15, 2009. The usual constant rate on these products is EURO O.07 per 1 kg. (Russian Government resolution №179, February 14, 2009)

The new tariff heading numbers of some milk products are included in the RF Customs Tariff since May 4, 2009. In particular, milk with fat content 1-3% 0401 20 310 is replaced by 0401 20 110 1 and 0401 20 110 9; milk with fat content 3-6% 0403 20 910 0 – by 0401 20 910 1 and 0401 20 910 9; other milk products with fat content not more than 3% 0403 90 510 0 – 0403 90 510 1, 0403 90 510 2 and 0403 90 510 9; other milk products with fat content 3-6% 0403 90 530 0 – by 0403 90 530 1, 0403 90 530 2 and 0403 90 530 9; curd 0406 10 200 1 – by 0406 10 200 2 and 0406 10 200 3. The amendments are made for dividing milk products for children food in small packages and the other milk products. The import customs duty rates on these products remain the same, as before. The RF Government also included new tariff heading numbers in the RF Customs Tariff for fixing second hand special road vehicles: other automobile cranes – 8705 10 009 5; trucks with drilling devices – 8705 20 000 5; fire-fighting trucks – 8705 30 005; trucks with concrete mixers – 8705 40 000 5; trucks for emergency purposes – 8705 90 100 5; trucks for pumping concrete solution – 8705 90 300 5; other special road vehicles – 8705 90 900 5. The temporary import customs duty rates on these second hand vehicles are set at EURO 4.4 per 1 cc of their engines capacity since April 4, 2009 for the period of 9 months. The rates on the new vehicles remain the same, as before. (Russian Government resolution №174, February 26, 2009).
