On August 29, 2007, the Ministry of Commerce released annual announcement No. 68, deciding to levy anti-dumping duties against imports of Bisphenol A originated in Japan, South Korea, Singapore and Taiwan region for a period of five years from August 30, 2007.

On November 22, 2007, the Ministry of Commerce released annual announcement No. 96, deciding that LG Chem, Ltd., Korea carried on the anti-dumping duty rate of 6.4% applicable to LG Petrochemical Co., Ltd. since November 23, 2007.

On December 15, 2009, the Ministry of Commerce released annual announcement No. 108, deciding to adjust the anti-dumping duty rate of LG Chem, Ltd., Korea from 6.4% to 4.7% since December 15, 2009.

On August 29, 2012, the Ministry of Commerce released annual announcement No. 43, deciding to conduct expiry review investigations into the anti-dumping measures applicable to imports of Bisphenol A originated in Japan, South Korea, Singapore and Taiwan region since August 30, 2012.

The products under investigation in this review are the same as those under the original anti-dumping investigation, i.e. Bisphenol A (BPA), which is listed under the tariff number: 29072300 in the Customs Import and Export Tariff of the People’s Republic of China. Bisphenol A salts under the tariff number is not covered in the range of investigation.

The Ministry of Commerce conducted investigation into the possibilities of continuation or reoccurrence of dumping and injury in case of terminating the anti-dumping measures applicable to imports of Bisphenol A originated in Japan, South Korea, Singapore and Taiwan region, and submitted proposals on maintaining the anti-dumping measures to Customs Tariff Commission of the State Council, based on findings of the investigation.

In accordance with Article 50 of the Regulations of the People’s Republic of China on Anti-dumping and the decision of the Customs Tariff Commission of the State Council, relevant matters are hereby announced as follows:

I. Ruling

The Ministry of Commerce ruled that dumping of imports of Bisphenol A originated in Japan, South Korea, Singapore and Taiwan region may reoccur, and the injury to the industry of Chinese Mainland caused by imports of the products under investigation may continue or reoccur if the original anti-dumping measures were terminated.

II. Anti-dumping Measures

The anti-dumping measures will be continuously levied against the imports of Bisphenol A originated in Japan, South Korea, Singapore and Taiwan region for a period of five years from August 30, 2013 according to the Announcement No. 68 of 2007, Announcement No. 96 of 2007 and Announcement No. 108 of 2009 by the Ministry of Commerce.

III. Methods of Anti-dumping Duties Levy

Importers shall pay related anti-dumping duties to the Customs of the People’s Republic of China when importing Bisphenol A originated in Japan, South Korea, Singapore and Taiwan region as of August 30, 2013. The anti-dumping duty shall be collected ad valorem on the basis of dutiable value authorized by Chinese Customs. The formula is: Anti-dumping duty= dutiable value authorized by the Customs x anti-dumping duty rate. Import VAT shall be collected ad valorem on the basis of dutiable value authorized by the Customs plus tariff plus anti-dumping duty.

IV. Administrative Reconsideration and Administrative Litigation

Where any party refuses to accept the review, it may, in accordance with Article 53 of the Regulations of the People’s Republic of China on Anti-dumping, apply for administrative reconsideration or institute legal proceedings in the people’s court.

V. The Announcement shall come into force as of August 30, 2013.
