On August 12, 2010, Ministry of Commerce of the People’s Republic of China (hereinafter referred to as the Ministry of Commerce) issued Announcement No. 47 of 2010, deciding to levy anti-dumping duties on imports of terephthalic acid originated in South Korea and Thailand. The anti-dumping duty rate applicable to KP CHEMICAL CORPORATION was 2.0%.

On June 3, 2013, LOTTE CHEMICAL CORPORATION filed an application to the Ministry of Commerce, requesting to succeed to the anti-dumping duty rate applicable to KP HEMICAL CORPORATION in the anti-dumping measures against terephthalic acid, and submitted relevant evidentiary materials such as the resolutions of Board of Directors and shareholders’ general meeting, the articles of associations before and after amendment, operation management, manufacturing equipment, supply relation, client bases and the certification documents from China’s Embassy in South Korea. On June 7, 2013, the Ministry of Commerce notified the domestic industry of terephthalic acid of the above-mentioned matters, which did not raise any objection within specified time.

Upon examination, the existing evidentiary materials indicate that the renaming of LOTTE CHEMICAL CORPORATION complies with relevant laws and regulations in South Korea. The operation management, manufacturing equipment, supply relation and client base in connection with the terephthalic acid remain unchanged before and after such renaming.

Therefore, the Ministry of Commerce decides that:
1. LOTTE CHEMICAL CORPORATION succeeds to the anti-dumping duty rate applicable to, i.e., 2.0%, and the other rights and obligations of KP CHEMICAL CORPORATION during anti-dumping measures against terephthalic acid.
2. LOTTE CHEMICAL CORPORATION may continuously engage in exports of terephthalic acid in the name of KP CHEMICAL CORPORATION to China, which shall be subject to anti-dumping duty at a rate applicable to other South Korean companies during anti-dumping measures against terephthalic acid, i.e., 11.2%.
This Announcement shall take effect as of August 8, 2013.
