The Ministry of Commerce of the People’s Republic of China received, on December 13, 2012, a formal petition for anti–dumping investigation submitted by Yibin Changyi Pulp Co., Ltd., Yanbian Shixian Bailu Papermaking Co., Ltd., Fujian Qingshan Paper Industry Co., Ltd., Fujian Nanping Paper Co., Ltd., Hebei Wallin Textile Raw Materials Co., Ltd., Yumen Huayu Textile Co., Ltd. and Guizhou Chitianhua Paper Industry Co., Ltd. (hereinafter referred to as “the Petitioners”) on behalf of domestic pulp industry, in which the Petitioners requested an anti–dumping investigation against imports of cellulose pulp native to the U.S., Canada and Brazil.

In accordance with the Regulations of the People’s Republic of China on Anti-dumping, the Ministry of Commerce has reviewed the qualification of the Petitioners, relevant conditions of imported products under investigation, relevant conditions of similar products in China, impact on the domestic industry of imported products under investigation and relevant conditions of countries (regions) involved etc. The Ministry of Commerce has also reviewed the evidence of dumping, injury and the causal link between dumping and injury as stated in the petition provided by the Petitioners. The evidence initially provided by the Petitioners suggests that, total output of cellulose pulp products manufactured by the Petitioners as well as Hunan Juntai Pulp & Paper Co., Ltd., Shandong Sun Paper Industry Joint Stock Co., Ltd., Manas Xiangyun Chemical Fiber Co., Ltd., Xinjiang Fangcaohu Wanxiang Chemical Fiber Co., Ltd., Yibin Zhuhai Bamboo Resource Science and Technology Co., Ltd., Yanling Chaofa Cotton Co., Ltd., Xinjiang Taichang Industry Co., Ltd. and Aral Xinnong Cotton Pulp Co., Ltd., which support the petition thereof comply with the requirements of Articles 11, 13 and 17 of the Regulations of the People’s Republic of China on Anti-dumping on filing a petition for anti-dumping investigation by the domestic industry. Meanwhile, the petition contains the contents and related evidence required for anti-dumping investigation by Articles 14 and 15 of the Regulations of the People’s Republic of China on Anti-dumping.

In accordance with the above-mentioned review results and the provisions of Article 16 of the Regulations of the People’s Republic of Chinaon Anti-dumping, the Ministry of Commerce has decided to initiate an anti-dumping investigation against imports of cellulose pulp native totheU.S., Canada and Brazil as of February 6, 2013. And matters of concern are hereby announced as follows:

I. Filing for Investigation and Period of Investigation

As of the date of issuance of this Announcement, the Ministry of Commerce performs an anti-dumping investigation against imports ofcellulose pulp native to the U.S., Canada and Brazil, and the period of anti-dumping investigation as determined for this investigation is from January 1, 2012 to December 31, 2012, and that of industry injury investigation is from January 1, 2010 to December 31, 2012.

II. Products under Investigation and Scope of Investigation

Scope of Investigation: imports of cellulose pulp native to the U.S., Canada and Brazil

Name of Products under Investigation: cellulose pulp, or dissolving pulp, or dissolving wood pulp, or cotton linter pulp, or bamboo pulp, etc.

Detailed Description: cellulose pulp refers to a type of plantfiber–based cellulosic material which is manufactured through processing for producing such chemical fibers as viscose and cellulose acetate fiber.

Main Usage: cellulose pulp is mainly used for the production of such chemical fibers as viscose (e.g. viscose staple fiber, viscose filament yarn) and cellulose acetate fiber.

The product is included under tariff numbers of 47020000, 47061000 and 47063000 in the Customs Import and Export Tariff of the People’s Republic of China.

III. Registration for Responding

As for the anti-dumping investigation, any interested party may, within 20 days as of the date of issuance of this Announcement, register with the Bureau of Fair Trade for Imports and Exports of MOFCOM for responding, and exporters or manufacturers registered for responding shall provide the volume and value of products under investigation exported to China from January 1, 2012 to December 31, 2012. TheReference Format for Responding to Anti-dumping Investigation is available for download under the column of “Case Trend” on the website of the Bureau of Fair Trade for Imports and Exports, a sub web of the website of the Ministry of Commerce (http://gpj.mofcom.gov.cn).

As for the industry injury investigation, any interested party may, within 20 days as of the date of issuance of this Announcement, register with the Bureau of Industry Injury Investigation of MOFCOM for responding, and also provide such explanatory information as production capacity, output, inventory, plans for construction in progress and expansion within the period of industry injury investigation and the volume and value of the products under investigation exported to China. The Application Form for Participation in Industry Injury Investigation against Dumping of Cellulose pulp is available for download under the column of Registration for Responding on “China Trade Remedy Information” athttp://www.cacs.gov.cn.

IV. Rights of Interested Parties

Any interested party may access to non-confidential text of the petition submitted by the Petitioners under the column of “Case Trend” on the website of the Bureau of Fair Trade for Imports and Exports, a sub web of the website of the Ministry of Commerce (http://gpj.mofcom.gov.cn) or visit MOFCOM Trade Remedy Public Information Consultation Office for reference (Tel: 86–10–65197878).

Any interested party may submit written comments to the Ministry of Commerce within the registration period, if it has objections to the coverage of the products under investigation, qualification of the Petitioners, countries under investigation and other related issues with regard to this investigation.

V. Methods of Investigation

Investigation authorities may adopt the methods of questionnaire, sampling, hearing, on-site verification or other methods to obtain and investigate information from interested parties.

VI. Questionnaire

Questionnaire on Dumping of Cellulose pulp in the Anti-dumping Case

Within 10 business days upon the expiration of the registered response as specified in this Announcement, the Ministry of Commerce will distribute the Questionnaire to the registered responding companies and other companies listed in the petition. The Questionnaire consists of such matters as organization and operation of the company, products under investigation, export sales to China (Mainland), domestic (regional) sales, export sales to other countries (regions) other than China (Mainland), cost of production and correlative expenses, estimated dumping margin and check slip etc. The Questionnaire on Dumping of Cellulose pulp in the Anti-dumping Case whereuponis available for download under the column “Case Trend” on the website of Bureau of Fair Trade for Imports and Exports, a sub web of the website of the Ministry of Commerce (http://gpj.mofcom.gov.cn). Other companies not registered for the response may directly download or ask the Ministry of Commerce for the Questionnaire and then complete and submit it as required.

All the above mentioned companies shall submit their answers to the Questionnaire in a complete and accurate manner within the specified period of time. The Questionnaire shall contain all the information required thereof, which shall be returned to the Ministry of Commerce within 37 days as of distribution of the Questionnaire. Responding companies demonstrating that they cannot complete the Questionnaire by the expiry date with just causes shall, seven days prior to the deadline of submitting the answers, submit a written application to the Ministry of Commerce for an extension stating the request for extension and reasons accordingly.

As for responding companies that fail to submit their questionnaire within the specified period of time or fail to submit a complete and accurate questionnaire as required, or refuse the Ministry of Commerce to verify the information provided by them, or seriously impede the investigation in other ways, the Ministry of Commerce may make a decision based on obtained facts and best available information in accordance with Article 21 of the Regulations of the People’s Republic of China on Anti-dumping.

VII. Starting from February 6, 2013, the investigation shall be completed by February 6, 2014 in normal circumstances and may be extended to August 6, 2014 in the event of special circumstances.
