On April 8, 2009, Ministry of Commerce of the People’s Republic of China issued Announcement No.18 of 2009, deciding to continue to impose anti-dumping duties against imports of acrylic ester originated in Malaysia, Singapore and Indonesia;i.e. such anti-dumping measure was extended for 5 years as ofApril 9, 2009 and will expire on April 9, 2014.

In accordance with the provisions of Article 48 of Regulations of the People’s Republic of China on Anti-dumping, the period for levy of anti-dumping duties and the period for fulfillment of price commitment shall not exceed 5 years; however, where termination of levy of anti-dumping duties after review is likely to lead tothe continuance or reoccurrence of dumping and injury, the period for the levy of anti-dumping duties may be extended appropriately.

As of the issuance of the Announcement, any natural person, legal person or relevant organization of or on behalf of domestic industry may, within 60 days before the expiration of suchanti-dumping measure, apply for expiry review in written form to the Ministry of Commerce. The application shall include an express statement on request for expiry review, and sufficient evidence proving that the termination of the anti-dumping measure may cause the continuance or reoccurrence of dumping and injury.

If neither thenatural person, legal person or relevant organization of or on behalf of domestic industry applies for such review in accordance with the Announcement, nor the Ministry of Commerce actively initiates such expiry review before the expiration of such anti-dumping measure, the aforesaid anti-dumping measure will expire on April 9, 2014.
